By using the Nexlares website or platform, you agree to be bound by these Terms of Service. Please read them carefully before opening an account or placing any orders.
1. Eligibility
You must be at least 18 years old, legally able to enter into a binding contract, and not resident in any jurisdiction where the use of the platform would be unlawful. Canadian residents are required to satisfy applicable suitability and identification checks.
2. Account Registration
You agree to provide accurate, current information when opening an account and to keep your credentials confidential. You are responsible for all activity that occurs under your login. Notify us immediately if you suspect unauthorised access.
3. Acceptable Use
You may not use the platform to facilitate fraud, money laundering, market abuse, or any activity that breaches Canadian law. Automated trading is permitted only via documented and approved interfaces.
4. Investment Risk
Investing involves risk, including the possible loss of principal. Past performance is not indicative of future results. We provide tools and information but you remain solely responsible for decisions you make. If in doubt about suitability, consult an independent adviser.
5. Fees
All applicable fees are published inside the dashboard before any order is placed. We reserve the right to update the schedule with at least thirty days' written notice.
6. Withdrawals
Withdrawals can be requested at any time and are processed under the published settlement timelines. We may delay or refuse a withdrawal if compliance checks remain outstanding, or if a regulator has issued a binding instruction.
7. Intellectual Property
All content displayed on this website — including software, text, graphics and trademarks — remains our property or that of our licensors. You may not reproduce or redistribute material without prior written permission.
8. Limitation of Liability
To the extent permitted by applicable Canadian law, our liability for any claim arising out of the use of the platform shall not exceed the total fees you paid in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses.
9. Termination
We may suspend or close any account that breaches these terms, is associated with prohibited conduct, or has remained dormant for an extended period. You may close your account at any time after settling open positions.
10. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute is subject to the exclusive jurisdiction of the courts of Ontario.
